On April 23, 2020, US President Donald Trump signed an executive order temporarily suspending a portion of immigration activities into the US for 60 days to protect jobs for workers in this country during the pandemic.
According to information from USIS Group – the best global immigration investment consulting unit, the subjects will be affected and will be exempted by this Administrative Decree, specifically as follows:
1. Affected people and sponsorship categories:
- Child sponsoring Parents IR5
- Parents with Citizenship sponsoring single children over 21 years old F1
- Parents with citizenship sponsoring married children over 21 years old F3
- Green card parents sponsor single children over 21 years old F2B
- F4 sibling sponsorship
- Permanent resident sponsoring F2A spouse
- Area for people with special abilities EB1
2. Exempt persons and sponsorship categories:
– EB-5 investment category
– Spouses and single children under 21 years old of US Citizens CR1, IR1, IR2
– Doctors, nurses, or other medical professionals can bring their spouses and children under 21 years old
– Spouses, Children of American Soldiers
– People invited by the US Government to serve the Government.
In addition, the Executive Order does not affect tourists, businessmen, or highly skilled workers with non-immigrant visas or student visas.
A representative of USIS Group explained further: “The EB-5 investment category is an immigrant investment program for qualified foreigners to invest in a project or business in the US, and be granted a green card to become a permanent resident of the US. The program’s required investment amount is 900,000 USD and creates at least 10 full-time jobs for Americans. This type of investment brings many economic benefits and jobs to the United States, so it is always strongly supported by the US Government.”
In fiscal 2019, the US issued more than 1 million green cards, half of which were to subjects with close family relationships to people who were already US citizens.
This entry ban measure will be effective for at least 60 days. It can then be extended for another 60 days or longer. Mr. Trump also said he would review economic data before deciding to extend the ban, implicitly indicating that once the US economy recovers strongly, this entry ban will be lifted.
The US President has repeatedly sought to prevent immigration since he came to power in January 2017. In 2018, the US Supreme Court ruled that the president has the right to prevent certain groups of foreigners from entering the US if they are a security risk. The US Immigration and Nationality Act of 1965 also allows the president to ban foreigners from entering the US if it is determined that they “harm” US interests.
