EB3 Visa – US immigration for skilled, professional, unskilled workers requires approval of supporting Form I-140 by the prospective employer.

For businesses that employ workers

Form I-140 approval is required
Must have favorable labor certification by the department of labor.

There are 3 types of labor:

A skilled worker is someone whose job requires a minimum of 2 years of training or work experience that is not temporary or seasonal.
Professionals are members of professions where the job requires at least a bachelor’s degree from an American university or college or compatible qualification.
Unskilled workers are qualified to fill positions requiring less than two years of training or experience that are not temporary or seasonal.

Visa application criteria

Unskilled workers (Other workers)	You must be in good health, at the time of the visa application, the consulting unit will advise you on your behalf, performing general work (requiring less than 2 years of experience or training), not falling into the group of temporary temporary jobs. seasonal or temporary and are jobs for which qualified workers are not yet available in the United States.	A labor certificate and a permanent, full-time job offer are required.

People who can accompany them to settle in the US under a 3rd priority visa

Your spouse can immigrate to the United States under E34 (spouse of “skilled workers” or “professionals”) or EW4 (spouse of “other workers” ) . While you and your spouse are applying to immigrate to the United States (green card application), your spouse will be eligible to assist in applying for an Employment Authorization Document (EAD). Your minor children (under 21 years old) can immigrate to the United States under the E35 (children of “skilled workers” or “professionals”) or EW5 (children of “professionals”) other workers).
