The United States Supreme Court on Monday, January 27, issued a ruling that allows President Donald Trump’s government to implement new regulations related to the issuance of green cards, which may make people People living in the US who receive food stamps, Medicaid, and housing vouchers have difficulty getting green cards.
Under the new regulations, immigration officials can refuse to issue green cards to legal immigrants because they receive social assistance.
With 5 votes in favor and 4 votes against, the Supreme Court overturned the decision of the 2nd Court of Appeals in New York that prevented nationwide enforcement of the new regulations, after lawsuits were filed. Appeals courts in San Francisco and Richmond, Virginia, previously allowed the new rule to be implemented. There is still a moratorium in place in the state of Illinois.
Applications will continue, but green card applicants will need to demonstrate that they will not be a public charge or burden to the United States.
The new policy applies to petitions postmarked (or electronically filed) on or after February 24, 2020. USCIS also updated the new petition forms and instructions on the USCIS website.
