PROBLEM OF APPROVEMENT OF GUARANTEE APPLICATION AFTER THE GUARANTEE’S DEATH

U.S. Immigration Services has adjusted its policy regarding the review of petitions after the sponsor’s death. In previous years, the United States Citizenship and Services Office (USCIS) said that US immigration law did not allow a sponsor applying for a visa to have a petition approved if the sponsor passed away. While the application is awaiting review. But now, changes in immigration law allow approval of petitions or petitions for Green Cards, but must meet the following mandatory conditions:
The sponsor must be living in the United States at the time of the sponsor’s death, and the applicant must continue to reside in the United States until the date of the decision on the petition or petition for change of status.

This law change will not bring any benefit to relatives living in Vietnam when the sponsor passes away. In this case, relatives in Vietnam must turn to the Family Sponsorship Act. This law states that if the sponsor dies after the petition is approved, applicants will be considered for immigration if they have a family member in the United States who can provide evidence of financial sponsorship. chief. And there must be very humane elements. Without humanitarian factors, the immigration department will most likely not approve.

Some examples of very humanitarian reasons are that the person being sponsored is the last family member remaining in Vietnam, or the applicant is having health problems and wishes to be treated in the US with help. family support or the applicant is facing many economic difficulties that cannot be resolved in Vietnam.

In addition, there must also be proof of contact between the sponsor and the sponsored person from the date of filing the petition, proof of connection to the United States, contact with other family members in the United States, and evidence that the sponsor’s family members in the United States are willing and able to assist the sponsor until they can become self-sufficient.
